Privacy Law changes

On 12 March 2014, the Privacy Amendment (Enhancing Privacy Protection) Act 2012 (Cwth) will come into effect.

There are many changes to the Privacy Act, including a new set of harmonised Australian Privacy Principles (APPs) that will apply to both organisations and Government agencies. A number of these are significantly different from the existing principles.

New Act for workplace injuries and compensation

The Victorian parliament recently passed the Workplace Injury Rehabilitation and Compensation Act 2013. The Act consolidates the Accident Compensation Act 1985 (Vic) and the Accident Compensation (WorkCover Insurance) Act 1993 (Vic) into one single piece of legislation.

Assisting victims of disaster

The recent NSW bushfires have been declared a disaster for the purposes of establishing Disaster Relief Funds. If your Not For Profit would like to support victims of the NSW bushfires the Australian Tax Office have prepared a number of fact sheets on disaster relief funds and fundraising for victims of disaster.

New DGR category for Ethics classes

Eligible providers of ethics education in government schools can now apply to the Australian Tax Office (ATO) for endorsement as a tax deductible recipient. The new legislation simplifies the process enabling organisations to apply directly to the ATO rather than seeking a Parliamentary amendment.

Charities Act 2013 - a new definition of charity

The Charities Act 2013 recently passed in the Federal Parliament and takes effect from 1 January 2014.

The Act introduces a new statutory definition of "charity" that will apply to all existing commonwealth legislation that uses the term. The new definition does not significantly change the existing legal definition of a charity. Instead it puts it into a statutory form, while adding several new elements to provide greater certainty about which organisations are charities, and what activities are charitable.

Living Longer, Living Better - Aged Care Reforms

The regulation and funding of the aged care sector is currently undergoing significant changes as part of the Federal Governments’ Living Longer, Living Better aged care reform package.

On 28 June 2013 the five bills that implement the reforms passed into law and will amend the Aged Care Act 1997 (Cwth) progressively from 1 August 2013.

National Disability Insurance Scheme launched

10 July 2013

From 1 July 2013 Victoria’s Barwon area will host the Victorian launch of the National Disability Insurance Scheme (NDIS).

During the launch period over 5,000 clients will transition to the NDIS, with all existing clients and service providers in the Barwon area expected to transition by September 2014.

Information update: Co-operatives National Law

12 April 2013

The Victorian Government recently passed legislation to adopt the Co-Operatives National Law and National Regulations, which will replace Victoria’s current laws regulating co-operatives. The Co-Operatives National Law is intended to provide a nationally consistent approach to the regulation of co-operatives, reduce red tape and make it easier for co-operatives to operate in other State and Territories.

A commencement date for the new legislation is yet to be announced.

Reducing the alcohol and drug toll: Victoria's plan 2013 - 2017

Victoria’s first whole of government strategy to reduce the impact of alcohol and drug abuse on the Victorian community has been released. The strategy sets out a 15-point plan that provides a comprehensive response focusing on care, treatment and recovery, as well as strengthening leadership and coordinated action in reducing the alcohol and drug toll.

Australian Charities and Not-for-profits Commission (ACNC)

12 December 2012

Australia’s first national, independent regulator of charities, the Australian Charities and Not-for-profits Commission (ACNC) commenced on 3 December 2012. The ACNC is responsible for registering Not for Profits as charities and supporting them to understand and meet their obligations under the Australian Charities and Not-for-profits Commission Act 2012.
